监管提示:泰国公共建筑行业承包商注册新规

前言

2026年1月13日在政府公报上发布的《规定企业经营者注册资格标准的部长条例(第2号)》对2017年《公共采购和供应管理法》下关于泰国公共采购项目承包商注册的监管方案进行了重大修改。

新部长条例:

  1. 延长对注册承包商资格进行监测和核实的法定间隔;
  2. 引入正式的注册承包商降级机制;
  3. 细化并扩大了注销登记的理由;
  4. 废除并取代以往的收费标准。 

延长资格核查监测期

新部长条例正式将注册经营者资格的核查检测期从两年延长至三年,自向审计署注册之日起计算。因此,注册承包商可从更长的合规周期中受益,从而有更多时间准备资格核查并确保持续遵守适用的注册要求。 

注册承包商降级及恢复原级别

此前,根据《2017年第2560号部长条例》(BE 2560 (2017)),并未明确规定承包商注册等级降级的机制。新的部长条例引入了正式的降级机制。注册等级被降级的承包商将被限制只能参与与其降级等级相对应的公共项目投标和承接,这可能会严重影响其在公共部门的业务机会。此外,任何因未能达到标准(根据《公共服务市场法》第106条第3款确定)而被暂时禁止向政府机构提交投标或签订合同的承包商,其注册等级将被自动降级。但是,被降级的承包商可以申请恢复到其原注册等级,前提是其符合《公共采购和供应管理法》下价格评估委员会规定的标准。 

注销(取消注册者身份)

新部长条例扩大了取消承包商注册者身份的理由。除涉及欺诈或提交虚假文件的情况外,如果承包商因施工方式不符合建筑工程专业工程标准,或在履行职责过程中存在重大过失,导致他人死亡,而被暂停与国家机构进行投标或签订合同(根据《公共采购和供应管理法》第106条第3款的规定确定),则该承包商也可被取消注册者资格。 

无资格期及重新申请条件

新部长条例还修订了关于无资格期和注销后重新申请条件的框架。与以往通常允许两年后重新注册的制度相比,新规明确规定了无资格期和重新申请条件,具体如下:

  1. 如果因缺乏基本资质而被取消注册者身份(例如,承包商未能满足拥有多数泰国董事的要求),则承包商必须从被取消资格之日起等待两年才能提交新的申请。

  2. 如果因放弃政府项目(根据《公共采购和供应管理法》第109条规定)而导致被取消注册者身份,则承包商可以在因该放弃行为而产生的禁止状态终止后提交新的申请。

  3. 如果因未能满足最低资质标准(例如财务能力、过往业绩、项目经验、机械或设备)而被取消注册者身份,且不涉及审计部门认定的不当行为,则承包商在满足适用的最低资质标准后可以提交新的申请。

  4. 如果因欺诈或提交虚假文件而被取消注册者身份,承包商必须自被取消之日起十年才能提交新的申请。

  5. 如果承包商因无法达到专业工程标准或因严重疏忽导致他人死亡而被取消注册者身份,则承包商必须自取消之日起两年后才能提交新的申请。 

收费标准表

先前的承包商注册收费标准也已被根据新部长条例颁布的新标准所取代。

承包商需注意的关键要点

参与公共建设项目工程的承包商应仔细审查其内部合规性、技术标准和风险管理程序,以确保在新监管框架下继续符合资格标准。尤其应关注专业工程标准、文件准确性和持续性资质要求。
